This article is based on a conceptual framework and aims to provide a clear picture of the legal status of Competitiveness Council to consider its role in determining the price of cars. In this regard, after providing a precise definition of regulation, the functions and features of the regulator institutions and its different types are studied; based on that we could obtain a better understanding on this matter. In order to find their relationship, a brief introduction of Competitiveness Council is provided, and then the responsibilities and authorities given by the legislative to this institution are taken into consideration from a pathological point of view. What eventually becomes clear is that despite the multi-sectoral nature of Competitiveness Council, it has not the authority to determine the prices at the car market and this action can be criticized in legal terms.

In the Islamic traditions, consultation has a high status and the prophet of Islam had to consult with people about executive affairs due to God’s commandments. Vulnerable religious leaders were also asked to consult with Muslims about their affairs and they submitted to the council’s results. And some religious commandments agreeable to Muslims are raised from the prophet’s companions council after his departure. Therefore, inferenced religious commandments can also be obtained by consulting those pronounce judgments, and the council pronouncing judgments can be a religious authority.This viewpoint doesn’t face any opposition and whatever indicates the necessity of imitation is itself a reason for lawfulness of pronouncing judgment through the council.

Competitiveness is considered as a key criterion for appraising the degree of success for countries, industries and enterprises in the political, economic and commercial competition areas. Research findings show that competitiveness has been discussed in three levels of national, industry and enterprise (organization or company). Among all these levels, the enterprise level seems to be more considerable. In this study enterprise competitiveness has been viewed from two main perspectives: construct and behavioral. According to construct perspective, competitiveness includes two groups of factors which are composing and affecting factors. Based on behavioral perspective an enterprise faces two types of factors in its decisions and actions which are strategic and operational ones. As a result of literature review, summarization and complementary edition, totally 28 factors have been identified as competitiveness factors ({16 composing f. and 12 affecting f.} and {15 strategic f. and 13 operational f.}). A questionnaire has also been developed based on these factors. The findings show that in Iranian business context, all competitiveness factors of enterprises are highly important but very weak.

In this research, with emphasis on the concern to improving public policies, the factors affecting the success of the council policy-making have been identified. In this qualitative study, the Supreme Administration council has been selected as the case study. Semi-structured interviews conducted with 15 administration experts and members of the Supreme Administration council who participated in formulate of the public policies. then we reviewed the existing documents and by using content analysis which is a qualitative method three main themes and 12 sub-themes were identified which include three general categories of content factors (Objective goals, stability in the patterns and theoretical foundations, The balance between the four dimensions of rationality, the common understanding of the problem), process factors (complete and transparent process, shared leadership, evidence-based policy making, the creation of appropriate Mechanisms for legitimization), and individual factors (Avoiding intra-group bias, Systematic approach, competence and merit of the members, Avoiding organizational bias).

In Islamic jurisprudence, arbitration is recognized as having the same nature as judgment, and it is considered to be a type of judgment itself. In the position of distinguishing the authority that issues judgments, the jurists have placed the judge of tahakim (which is the same as the referee) next to the judge appointed for the purpose of the chapter of hostility.In Imami jurisprudence, the possibility of collective judgment and arbitration is sometimes accepted in cases such as the issuance of a verdict in the case of a consensus of several judges. Also, the division of time or regional or jurisdictional work among judges has been accepted; However, considering the difference between collective judgment and council judgment, what is important is the answer to the question of whether it is possible for council judgment and arbitration by maintaining the independence of each judge and arbitrator and with the criterion of accepting the majority opinion, based on the jurisprudential foundations of the Islamic legal system. Legitimacy was given, and if legitimacy is proven, what evidence can support this way of judgment and arbitration?The issue of council judgment in jurisprudence texts has been less addressed by jurists. There is a possibility that the lack of consistent and lengthy jurisprudential literature on this issue is due to the silence of the Shariah and the lack of a narrative reason with a direct and explicit implication in negating and proving the legitimacy of the council's judgment and arbitration. However, the silence of the Shariah in proving the legitimacy of the council's judgment and the lack of coherent jurisprudential literature is not considered a valid reason for denying its legitimacy.
